1. PREAMBLE

The present conditions are concluded between, on the one hand, SmellWell Belgium, rue Guillaume Lekeu 10, 4802 Heusy, registered with the Carrefour des Entreprises bank under number BE0887.814.769, and, on the other hand, persons wishing to make a purchase via the SmellWellBelgium.be website, hereinafter referred to as “the customer”.

2. FIELDS OF APPLICATION

These terms and conditions apply to all sales of products presented on the www.smellwellbelgium.be website . Any order placed with SmellWell Belgium implies validation of the present general terms and conditions of sale and implies unreserved acceptance thereof.

3. STOCKS

The stock levels mentioned on the www.smellwellbelgium.be website are for information only, and are updated in real time. However, it is possible for two customers to order the last item in a series at the same time. In these circumstances, SmellWell Belgium undertakes to offer a new delivery date, depending on the supplier’s lead times, to one of the two customers if the item ordered needs to be reissued. In the event that the article does not need to be reissued, SmellWell Belgium undertakes to make a refund in the form of a voucher or to cancel the order and refund the customer as soon as possible.

4. DELIVERY AND DEADLINES

With regard to delivery times, SmellWell Belgium undertakes to hand over the order to a carrier within 5 to 7 working days from the day on which payment is validated by the financial institution that manages credit card collections. In the event of loss on delivery, SmellWell Belgium undertakes to reimburse the customer only after the carrier has officially declared the products ordered lost. In order to secure all shipments, items are sent in large waterproof envelopes and/or cardboard boxes via one of the delivery services SmellWell Belgium works with.

5. CONTRACT VALIDATION

In the case of credit card payments, the sales contract is deemed to have been concluded only once the customer’s account has been debited. In the case of payment by bank transfer, the sales contract is deemed to have been concluded once the payment has been recorded on the SmellWell Belgium bank account(BE33 7512 1274 1046).

6. ORDER

When you arrive at www.SmellWellBelgium.be, the home page offers a variety of product categories for more efficient searching. To purchase a product, simply click on the product sheet of your choice. To place an order, simply click on the “Add to cart” button. Your order will be automatically added to your shopping cart; you can then continue shopping and do the same for other models. For each model selected, the basket is filled in the “basket” menu at the top right of the site. Once the basket has been filled, you can place your order by clicking on the icon representing a bag or on the button showing the amount of the current basket in the top right-hand corner of the site, then click on the “Proceed to payment” button. Placing an order implies that the customer provides his or her correct delivery and billing addresses, checks the exact amount to be invoiced, including the price of each item and shipping costs, selects the delivery and payment method and clicks on “Check order”. On receipt of the order, the customer receives an envelope or parcel containing the item(s) ordered. Customers may receive their order in several packages.

7. SECURE PAYMENT

Online payment of products by credit card is made through Mollie. The data recorded by the Mollie payment system constitutes proof of the financial transactions carried out by bank card. Mollie does not transmit information relating to payment by bank card except, if necessary, in the event of a duly expressed complaint relating to a particular transaction. The customer declares that he/she has all the necessary authorizations for payment by credit or debit card when validating his/her order. In the event of suspicion of fraud, SmellWell Belgium reserves the right to initiate a procedure to obtain further information from the customer, requesting various forms of proof and, following this procedure, to cancel or suspend any order or delivery, even in the event of payment authorization issued by Mollie/.

8. RETRACTION OPTION RESERVED FOR PRIVATE INDIVIDUALS

Under the conditions provided for by law and in the context of distance selling, the buyer has a withdrawal period of 14 clear days from the delivery of his order, which will be reimbursed against the return of the products delivered. The buyer must return the goods in their original condition (i.e. always in the vacuum packaging). Goods are returned at the customer’s risk. The procedure for returning goods will be detailed in the order confirmation email sent to the customer. We advise the customer to keep the proof validated by the postal service used that the goods have been collected and returned to SmellWell Belgium, until SmellWell Belgium actually receives the return parcel. . SmellWell Belgium does not cover the cost of returning goods. for orders returned from Belgium (and only from Belgium).

In accordance with the law on the protection of privacy with regard to the processing of personal data, the customer has the right to access and rectify data concerning him or her. SmellWell Belgium guarantees the customer total respect for confidential information recorded on computer media. SmellWell Belgium undertakes not to divulge any information that might enable third parties to gain knowledge of confidential data within the meaning of the law on the protection of privacy with regard to the processing of personal data.

10. BELGIAN LAW, DISPUTES AND JURISDICTION

In the event of a dispute, only the courts of the judicial district of Verviers, ruling in accordance with Belgian law, will have jurisdiction.
